Warranty

All of our devices are backed by our 90-Day Warranty.  This Warranty is in effect upon the day the device is received.  The coverage provided by this warranty is limited to functionality defects that are the result of a failure caused by:

• Normal, intended use of the device
• A defective original battery as determined by our discretion
• Internal overheating
• Defects in materials/workmanship

In the event of a claim covered under this warranty, we will, at our sole discretion, either:

• Repair the device
• Provide a replacement device of the same kind, quality, functionality, and condition
• Provide a cash settlement or gift card reflecting the costs associated with replacing the device with one of the same kind, quality, functionality, and condition

This warranty does not cover:

• Accidental damage, including but not limited to, cracked screens, cracked back glass, cracked camera lenses, water damage etc.
• Any functionality defects arising from an accidental incident/misuse including, but not limited to, internal overheating, loss of facial recognition functionality, no-display/touch or partial display/touch, loss of camera functionality, loss of speaker functionality, loss of Wi-Fi connectivity and/or Bluetooth connectivity and/or network connectivity, loss of NFC functionality etc.
• Any damage or loss arising from causes other than normal usage and operation of the product in conformance with the manufacturer's specifications and owner's manual, including but not limited to exposure to weather conditions, failure to properly clean, maintain, or lubricate, operator negligence, misuse, abuse, improper electrical/power supply, improper equipment modifications, attachments, installation or assembly, vandalism, battery leakage, acts of nature (any accidents caused by unforeseeable physical events such as storms, perils of the sea, tornadoes, hurricanes, floods, and earthquakes), or any other peril originating from external sources shall not be deemed the responsibility of the manufacturer
• Lost, stolen, or irretrievable items
• Product with removed or altered serial numbers/imei numbers
• Devices that have undergone third-party repair services or that have been opened for any reason by any third-party

We may void this warranty at Our sole discretion on the basis of fraud or material misrepresentation by You.  In this case, notice will be sent via email.

Limit of Liability: Upon payment of the repairs or replacements in an aggregate equal to the Coverage Amount or a cash settlement equivalent to the cost of a new item with comparable features and functionality, We shall have fulfilled all obligations under the Warranty. No replacement device or component thereof shall be eligible for protection under this Warranty or by the Administrator in any manner.

Pursuant to the terms of this Warranty, any disputes related hereto shall be resolved exclusively on an individual basis and You hereby waive any right to commence or participate in any class, consolidated, or representative action against Us. Further, You acknowledge and agree to forego Your right to engage in class arbitration, class action, private attorney general action, or consolidation with other proceedings in connection with the Warranty.

It is hereby established that We shall not be held responsible for any indirect, incidental, or consequential damages, including but not limited to, property damage, lost time, or lost data, arising from any failure of the products.

This document, in conjunction with Your Order Summary, constitutes the complete agreement between the parties with respect to the Warranty, supersedes all prior negotiations, representations, warranties, and agreements, and constitutes the entire understanding of the parties with respect to the Warranty.
